Terms of Service


Here you'll find the simplified version of my ToS. For a Detailed version of my ToS, click the button below!

General Terms:

  • Anything here can be changed without notice. I highly recommend looking over these TOS before asking for a commission slot. I recommend even higher to check out the FULL TOS which I have linked below. They hold the higher power.

  • You are able to discuss with me anything in my TOS so that if something doesn't quite fit with a certain case will fit. I am not saying that I will just throw out something if asked, but things need to be discussed fully before I make a decision to either stand by what is here or throw it to the side. These are otherwise in stone and will not budge. "I just don't like this term/rule here," doesn't work as a reason and I will not take it.

  • By sending me a request for a commission slot, you agree to my Terms of Service. Not just those written here, but within the main file of my Terms of Service. Remember, the full TOS holds higher power over the Simple TOS.

  • The Simple TOS have been typed out to try to create a quick reference for anyone to look back to. To gain a more definitive answer to a question, either refer to the Full TOS (linked below) or ask me (KimaruSpell) directly.

  • I, the Artist, reserve the right to decline a commission for whatever reason. This also means I have the right to stop work on a commission if I feel that you have acted in a rude/inappropriate manner, given poor communication, or broken any of these TOS.

  • I won't draw anything that is prejudiced or racist in any manner or any hateful artwork.

  • I own the artwork while you, the client owns the character. My hard work and time goes into creating you a special art containing your character, so I keep rights to do things with the commission such as using it to promote my services. No, I will not go "hey, wanna buy a character(?)" to someone- that character is yours and all yours. The art, though, that's what we're covering here. You may pay a fee to keep the commission private. Look into my Commission Info for that pricing or just discuss with me.

  • You, the client, will not reproduce, distribute, or profit from the final commission. Yes, you can use it on your profiles or even on your YouTube channel, just so long as the commissioned art isn't the main thing bringing in your dough. This can be discussed a bit more in detail, just ask about the possibility and what we can work out.

  • You cannot alter, edit, or trace the commission in any way UNLESS I give you full and expressive permission.

  • I can close Commissions as I want/need to just as well as changing the base pricing due to demand/need.

  • I need clear and precise instructions, descriptions, and information to be able to bring forth a piece of art just for you, so please make sure that it's as clear as possible. Not as clear as mud...

  • I need the following Info from the client:
    +++ Name (or username, this way I can tag you to the commission.); Please don't change your username while I am working on your art!!!
    +++ Email (if applicable) to send an invoice or payment communications
    +++ Type/Category of commission wanted
    +++ Number of characters wanted in commission
    +++ Anything specific or details that you want included into the piece
    +++ The wanted Character(s) details/reference/description (be as clear as possible)

Payment:

  • I accept USD (United States Dollars) and so if you're not paying in USD and need to have them converted, then you're responsible to know what that rate is.

  • Wondering about using DA points/Site Currency? You can see if I will accept them, but I hold the right to say no. Depends on what the situation is.

  • Commissions may be paid either one hundred percent (100%) upfront or forty-five percent (45%) up to seventy-five percent (75%) upfront and the full remaining percentage paid after the "Sketch Approval". If I have taken the time for a sketch, that means that I have used time to work.

  • Please don't send payment until we have agreed on how the commission is going to work (also called a Commission Agreement) and I have sent a means for you to pay me.

Process/Delivery:

  • We'll talk about the terms and commission and then finally I will let you know when I get started. This is when you lose the right to a refund. Time spent is time I cannot refund or replace sadly. Time is money.

  • I will keep messaging and talking with you to ensure that the commission is going how it should or better. I want to make sure that you get what you're paying for. There can be a lot of reviews needed or there can be very few. It all depends on how complex you're wanting the commission.

  • Estimated time period for me to get a piece done can range from 1 week all the way up to 3 months, depending on several factors like life, health, commission type, and/or (but not limited to) complexity.

  • If you cancel BEFORE I start ANY work, you can get a refund. However, if you cancel AFTER I start any work, then you forfeit a refund (this only applies to whatever amount you do send me). Again, Time spent working on one commission is time lost working on something else that is needed. Sounds mean, but it's honest.

  • If I find you in any violation of my TOS and/or you present rude/inappropriate behavior or present poor communication, then your commission does stand to be cancelled and it will work just as if you cancelled the commission, resulting in no refund.

  • If at all the commission is cancelled, then I keep the right to use it as promotion for my services and so.

  • If I have any reason that I need to cancel it because I cannot get to it due to something major in life or health, then a refund is possible. That's an "act of nature" that neither you nor I can control.

  • A commission comes with up to 3 revisions initially, but an additional fee can be added due to a revision needed after I have finished the artwork or due to a revision being needed that needed to be caught in the previous review stage (these aren't the only reasons, but they're the examples given)

  • "Review Stages" are when I send a piece/WIP to you so that you can look it over and tell me if there are any corrections needed, colors selected, something missing, etc.

  • The Process will go essentially like:
    +++ I will make loose Drafts/Mockups, send them to you and await you to select the one you prefer (amount I send you caries on complexity and may be either thumbnails or slightly bigger). -Review Stage 1 goes here, after I send you the Drafts/mockups to look at. Let me know any corrections or so needed at this time.-
    +++ I will then take the info given and begin to work on the sketches (or final sketches depending on commission type). -Review Stage 2 goes here, after I send you the Sketches to get your approval/notes. Again, let me know any corrections needed at this time.-
    +++ I will then send or include you in the color plan (local colors or flats) to make sure that I get the coloring correct (and this applies if you got a commission that requires coloring). -Review Stage 3 goes right here, after I send you something that shows the main colors needed/being used in the commission. Let me know any corrections or fixes needed so I can put them to use.-
    +++ Finally, once I am done with creating the commission, then I will send you a full resolution file and a smaller one (that's web-friendly) if need be.

  • From the final piece, I will simply post to give an example of my commission work. That is unless you've paid for it to remain private.

Copyright/Usage & Infringement:

  • I just claim the rights to the artwork that I produced. You still own rights to the character, I am not buying the character from you. I am putting my years of practice to use when you commission me, so that art is still useable by me. I can use the final commission to help promote myself, but you can ask me not to use it while we plan the commission.

  • You can use a commission on your profiles or posts, but if someone asks who did it, then you must be fully honest and not claim the art. I would love it if you gave them my most current site/linkage as well!

  • You're welcome to use the final piece on a video or something that gets monetization (gets you money) just so long as the commission piece isn't what is bringing the money in. Example: You can use it as your YT profile picture, but that isn't what gets you money there. It's your videos and content gaining you monetization, not my finished commission piece.

  • You can get it printed to pin in your room or office, but just don't go around selling the prints (or stickers, shirt, etc.). That would make image for commercial use and that's not cool. Commercial usage is its own thing and it's NOT covered AT ALL in any of these Terms of Service. Please contact me if you want to inquire about commercial commission usage and pricing (IF AVAILABLE).

  • You cannot reproduce the piece, print it to sell, remove my signature, or alter/edit the commission piece in any way, form, or fashion. That breaks these Terms of Service and at that point, I retain the right to cancel the commission and refuse any further commissions from you.

About Me


Hey all and welcome by! I am delighted to welcome you to my site and thank you firstly before I go on about myself.
My name is Kira and I currently create artwork and commissions part-time to share it with whoever would love to see it.
I grew up in a small town raised by my grandmother for several years with little knowledge of how creating art could turn into something that I could share with people the world over. Oh, how wonderful the internet was at that time as I began to explore various art sites and image galleries of artists that ranged from traditional watercolors to digital animated emojis. I remember one site in particular that I would often reference on how to create those little animated icons that brightened several profiles.
As I grew a bit older and I continued my exploration as well as my own artistic pathway, I discovered that people would actually offer their services to create artwork for other people. Needless to say, this piqued my interest that was followed by several attempts, toe-dippings, and determination that I, too, could do this expansive task and add it to my journey.
